Terms and Conditions

The British Gas "Generation Green" programme (the "Programme") is restricted to schools in mainland Great Britain (England, Wales and Scotland) only. A "GB Person" is anyone aged 18 years or over who is a legal resident of England, Wales or Scotland.

By participating in the Programme, all Generation Green Schools and/or GB Persons will be deemed to have accepted and be bound by these Terms and Conditions and any requirements set out in any Programme related promotional materials.

Schools can participate in the Programme by (a) registering to join the Programme via www.generationgreen.co.uk to receive email confirmation that it is now an activated ‘Generation Green School’ and containing their unique username and password linked to their school (b) Participating in the Generation Green termly prize draw by uploading or downloading resources as per the terms and conditions of the termly prize draw at www.generationgreen.co.uk website or subsequent information made available by the Promoter ("Generation Green Activities"); or (c) Participating in the pupil competitions/prize draws as per the promoter’s terms and conditions.

By participating in the Programme, (i) Generation Green Schools consent to the Promoter using their details in press and/or publicity materials to promote the Programme, and (ii) GB Persons agree to participate in unpaid promotional related publicity regarding the Programme including photographic shoots and interviews for a period of 3 years after the Programme ends.

In the event that the Promoter believes there has been a breach of these Terms and Conditions or any attempt by any participant in the Programme to deliberately hack into or damage the www.generationgreen.co.uk website or to undermine or subvert in any way the legitimate operation of the Programme by deceptive or wilful activity or otherwise, the Promoter may disqualify the relevant Generation Green School from the Programme immediately.

Educators who are not affiliated with a School will not be eligible to participate in any School or teacher prize draws or competitions on www.generationgreen.co.uk. Upon request, a generic log-on can be provided for the purposes of accessing resources, but such users will not be eligible to participate in competitions or prize draws.

To facilitate the efficient and correct running of the Programme, Generation Green Schools agree to promptly co-operate in full with any request from the Promoter or its auditor or the Office of Gas and Electricity Markets (Ofgem) to provide documents or data relating to the operation of the Programme.  In particular, the Promoter and/or any auditor or Ofgem shall be permitted to access and to copy on giving at least 7 days written notice, documentation, data, or any other materials relevant to the Programme to ensure that Generation Green Schools are complying with these Terms and Conditions.

Subject to each Generation Green School’s statutory rights, the Promoter shall not be liable for any damages, claims or costs, however incurred (other than death or personal injury caused by negligence) arising from the Programme or the failure by a school to follow these Terms and Conditions or any other instructions for participants published in relation to the Programme.

The Promoter reserves the right to cancel the Programme at any time due to unforeseen circumstances arising beyond its control.

The Promoter is not responsible for any failure of any hardware and/or software and/or any Programme related submissions that are lost, delayed, corrupted, illegible, incomplete or damaged.  Proof of emailing does not constitute proof of delivery.

These Terms and Conditions shall be governed by and construed in accordance with the laws of England. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales, unless you live in Scotland in which case the laws of Scotland apply.

Registering Your School

A school is defined as a local council recognised primary or secondary educational institution, typically consisting of several year groups and incorporates any other additional support units such as Special Education Needs centres.

Whenever we ask you to give us information about your school, you agree to provide complete and accurate information.  Please note that the number of pupils registered at a school must include all year groups and any Special Education Needs centres.  It is your responsibility to ensure that the information provided by you on registration or at any other time are correct and complete. You must inform us immediately in writing of any changes to the information that you provided when registering by updating your school's details.

Security

We will only allow you to log on and access your school's account details if you use your email address and password. If we block your school's account you will need to phone us on 0845 070 2415 so that we can reactivate it. You must make sure that you do not disclose your password to individuals who are not authorised to access your school's account details, even to a member of our Generation Green team.  If you believe that somebody may know your school's password, you may change your password immediately through the Website or by phoning us on 0845 070 2415.

Contacting us

When your school has registered on the Website and you are logged in, you may contact us via the Website by visiting the Contact Us section, which you can access from most pages of the Website.

If you would prefer to phone us about your school's online account, you may call us on 0845 070 2415

Unused, lapsed and duplicate accounts:

Has registered more than once for the Programme;

Has not used its account for longer than 12 months; and/or

Has not provided accurate contact details when registering for the Programme.

Where possible we will contact you by email giving 1 month’s notice when we disable or delete a school's account.

If we disable or delete your school's account, you can ask us for a new online account at any time provided you are eligible to participate in the Programme.

Copyright and other Intellectual Property Rights 

You may only make a copy for your school's non-commercial use.

The copies must keep all copyright and other proprietary notices intact.

Images, text and teaching materials on this Website are protected by copyright and other intellectual property rights and you must not reproduce them or use them in any way without the owner's written permission.

Changes to these Terms

We have the right to change these Terms at any time by putting the changes on this Website. It is your responsibility to read the Terms regularly to make sure you are aware of any changes. If you use this Website after we have made a change to the Terms, we will take this to mean you have accepted the revised Terms. The information and other materials on this Website may not meet the laws of any other country. If you access this Website from another country, you are responsible for making sure you meet any local laws. The phone numbers provided only apply to phone calls made from within Great Britain.

The laws of England and Wales apply to these Terms and any terms and conditions relating to the Programme. If there is a dispute about these Terms, this will be dealt with in the courts of England and Wales, unless you live in Scotland in which case the laws of Scotland apply.

Generation Green Prize Draw Terms and Conditions

 

1.    This prize draw is open to primary and secondary schools in mainland Great Britain.

2.    Entrants must be a registered user of www.generationgreen.co.uk

3.    To enter the draw;

 

a) Each lesson plan or activity downloaded by the registered user will gain 1 entry into the prize draw on behalf of the School; and / or

 

b) Each upload of shared lesson plans onto www.generationgreen.co.uk equals 1 entry into the draw on behalf of the School.

 

4.    There is no restriction on the amount of entries made per school, but no school may win more than one prize.

5.    Opening date for the prize draw is 28th March 2012

6.    Closing date for receipt of entries is midnight on 15th June 2012.

7.    No applications automatically generated by computer, or incomplete or corrupted entries will be accepted.  Entries will only be accepted if they comply with all entry instructions. Responsibility is not accepted for entries lost, damaged or delayed as a result of any network, computer hardware or software failure of any kind. Proof of sending will not be accepted as proof of receipt.

8.    Winners will be drawn at random by an independent judge from all entries received by the closing date.

9.    A Grand Prize is solar PV panels.  A Grand Prize is subject to survey by the Promoter to ensure that the winning school will benefit from the Grand Prize. Each winner of a Grand Prize will receive and must agree to the full solar PV panel terms and conditions and any other necessary documentation after a successful survey by the Promoter. 

10.  It is the winning School’s responsibility to obtain the necessary checks, consents and / or permissions from any relevant organisation or individual, in order to accept a Grand Prize.

11.  All the Promoter's products and services will be installed subject to and in accordance with the terms and conditions of the installation agreement which will be provided by the Promoter at the time of installation and must be accepted by any winning School.

12.  All prize winning Schools will be notified by email, post or telephone within 14 days of the closing date. 

13.   Grand Prize winners will be required to confirm in writing that they wish to accept the prize by the given day specified by the Promoter in the winner notification letter, email or telephone call.

14.  For the Grand Prize winners, the Promoter will organise a suitable time to carry out the site survey to determine eligibility for the Grand Prize upon notification. In the event that any Grand Prize winner is not eligible for the Grand Prize after site survey, the Promoter may offer the school the option of nominating another building in their local area to receive the Grand Prize (subject to site survey by the Promoter).

15.  If for any reason a Grand Prize winning school is considered to be unsuitable following site survey or does not accept or nominate the Grand Prize, the Promoter reserves the right to offer the prize to a substitute winner selected in accordance with the promotion rules.

16.  The Promoter aims to complete the survey and installation within 12 months from the closing date. The Promoter and its agents cannot accept responsibility for any delay caused due to circumstances outside its control.

17.  In the event of any dispute the decision of the Promoter is final.

18.  A Grand Prize cannot be exchanged or redeemed for cash or any other product or service offered by the Promoter.

19.  A winning school's details (name and county) will be made available on request to those writing to the Promoter within ten weeks after the closing date, enclosing a stamped SAE.

20.  All prize-winning Schools and participating individuals may be required to participate in publicity arising from this promotion.  By entering the prize draw all prize winning Schools and participating individuals agree that their image and likeness may be used by the Promoter in unpaid promotional activity (including photographic shots and interviews), for a limited period of 5 years from the date of the draw.

21.  Participants acknowledge that the Promoter may combine personal information provided to participate in this draw with the Promoter’s existing data records in accordance with the Data Protection Act 1998. For more information please see our Privacy Policy which can be found at www.britishgas.co.uk/privacy.  By entering into the draw, the winning school and its representative/s consent to being contacted by the Promoter in accordance with the Data Protection Act 1998.  The Promoter may contact any entering school via email, phone or text messaging in order to:

  • Keep you updated about your entry into the draw
  • Arrange the relevant survey and installation in the event of you being the winning school
  • Keep you informed about British Gas education and British Gas products and services that are relevant to schools (including micro-generation offers, energyshare and MySolar School)

 

26.                By entering the promotion, all entrants will be deemed to have accepted and be bound by these terms and conditions and any accompanying promotional material.  All entry instructions form part of the rules.  The Promoter reserves the right to refuse entry, disqualify any entry or select alternative winner(s) in the event that it believes that any school, or member of any school has contravened these terms and conditions.

 

27.  These terms and conditions and any issues or disputes which may arise out of or in connection with these terms and conditions (whether such disputes or issues are contractual or non-contractual in nature, such as claims in tort, for breach of statute or regulation or otherwise) shall be governed by and construed in accordance with English law.
